Real Estate Meets Electromobility – Law and Practice in a Commercial Context

Today's focus is on the interface between building management and electromobility with a special focus on rented properties in a commercial context. The following experts are invited to attend:

The first part of the webinar covers the obligations of owners and the rights of tenants with regard to the installation of charging infrastructure. After an introduction to the Building Electric Mobility Infrastructure Act (GEIG) and the rights of tenants under the German Civil Code (BGB), the tensions between these rights and obligations will be examined in more detail: Can an owner shift the obligation to install charging infrastructure to tenants? Can an owner transfer exclusive rights to install charging infrastructure to a third party? How does this fit with tenant entitlements?

The second part of the webinar will provide drafting tips for land use agreements and leases. By means of land use agreements, charging station operators are permitted to set up and operate charging infrastructure on third-party property. Building owners are increasingly confronted with this type of contract - either on their own initiative to fulfill the obligation under the GEIG, or they are approached by charging pole operators due to the attractiveness of the locations. The webinar will explain what needs to be considered in these contracts and how such agreements affect the lease. In addition, it will also be discussed how the topic of charging infrastructure should be regulated in the lease agreement.

Charging infrastructure is also increasingly found in decentralized supply constellations, which will be further strengthened by the solar carport obligation. What needs to be considered in these constellations, especially in rented properties, is the subject of the third part of the webinar. Topics include in particular metering, apportionments and levies, and other aspects that may need to be overcome in different business models.

During the webinar participants can submit their questions to get them answered by the experts in the live Q&A. In addition, both the recording and the speakers' presentations are made available to all registrants after the webinar.

Dr. Karla Klasen – Lawyer, Osborne Clarke

Dr. Karla Klasen advises clients on energy law issues. She specializes in renewable energy projects, electromobility and legal issues concerning the digitalization of the energy industry.

She advises clients on the regulatory aspects of charging infrastructure and assists in drafting contracts with hardware suppliers and back-end providers. Karla is a member of the "Charging Infrastructure" working group at the German eMobility Association (BEM).

Dr. Alexander Dlouhy – Master of Laws, Head of the German Energy & Utilities sector group, Osborne Clarke

Dr. Alexander Dlouhy regularly advises on transactions, joint ventures, cooperations and projects with a focus on the energy sector and business models (e.g. software-based services, start-up investments, eMobility, contracting and tenant flow).

One focus of his work is on the regulatory aspects of projects and business models and the related energy supply contracts.
In the field of eMobility, he regularly advises operators of charging infrastructure and eMobility providers on the regulatory framework and the drafting of contracts, e.g. supply contracts and software as a service contracts (back-end).
